FOIA Requests
The Virginia Freedom of Information Act (FOIA), located ยง 2.2-3700 et seq. of the Code of Virginia, guarantees citizens of the Commonwealth and representatives of the media access to public records held by public bodies, public officials, and public employees. Please refer to the policies below for the Rights of Requesters and the Responsibilities of New Kent County Public Schools under the Virginia Freedom of Information Act.
Policies KBA, KBA-E, KBA-F1, KBA-F2, and KBA-R can all be found in Section K of our NKCPS Policy Manual: NKCPS Policy Manual>Section K - School Community Relations.
The current NKCPS FOIA Compliance Officer is Johanna Davis, Executive Assistant to the Superintendent and Clerk of the School Board.
New Kent County Public Schools must respond to a request within five working days of receiving it. Day One is considered the day after the request is received. The 5-day period does not include weekends or holidays.
If you believe that your FOIA rights have been violated, you may file a petition in district or circuit court to compel compliance with FOIA. Alternatively, you may contact the FOIA Council for a nonbinding advisory opinion at (804) 225-3036 or foiacouncil@dls.virginia.gov.
